GoDaddy - AI 이용 약관

1. 개요

본 이용 약관("AI 이용 약관")은 GoDaddy.com, LLC 또는 그 제휴사("GoDaddy")가 제공하는 AI 제품, 기능, 봇, 에이전트, 서비스 및/또는 도구("AI 서비스")로 구성된 모든 서비스의 이용에 적용됩니다. 또한, 귀하의 AI 서비스 이용은 GoDaddy의 '범용 서비스 약관', '글로벌 개인정보 공지', '데이터 처리 부속서' 및 모든 해당 제품별 약관 또는 귀하가 당사 AI 서비스를 이용하는 사이트에 적용되는 모든 약관(AI 이용 약관과 함께 총칭하여 “계약”)에 따릅니다. 정의되어본 AI 이용 약관에서 사용하지만 정의되지 않은 대문자 용어는 계약 내 다른 부분에 명시된 의미를 가집니다.

2. 콘텐츠 일반

귀하는 AI 서비스에 입력(“입력”)을 제공하고, 입력에 따라 AI 서비스로부터 출력(“출력”)을 받을 수 있습니다. 입력에는 AI 서비스의 일환으로 귀하가 제공하는 모든 피드백, 지시, 정보 또는 프롬프트가 포함되나 이에 국한되지 않습니다. 입력과 출력을 총칭하여 “콘텐츠”라고 합니다. 귀하는 모든 콘텐츠에 대한 책임을 지며, 해당 콘텐츠가 적용 가능한 법률이나 본 AI 이용 약관 또는 계약상의 기타 약관을 위반하지 않으며, 제3자의 지적 재산권, 퍼블리시티권, 프라이버시권 또는 기타 소유권을 침해하지 않도록 보장해야 합니다.
GoDaddy은(는) AI 서비스 및 기타 서비스(범용 서비스 약관에서 정의된 바와 같이)에 대한 모든 권리, 소유권 및 이익은 전적으로 소유하며, 본 AI 이용 약관의 어떠한 내용도 귀하에게 AI 서비스에 대한 소유권을 부여하는 것으로 간주되지 않습니다.
귀하와 GoDaddy 간에, 그리고 관련 법률이 허용하는 범위 내에서 귀하는 (a) 입력물에 대한 소유권을 보유하며 (b) 출력을 소유합니다. 적용 가능한 법률이 허용하는 범위 내에서 당사는 출력에 대한 당사의 모든 권리, 소유권 및 이익(있는 경우)을 귀하에게 양도합니다.
당사는 콘텐츠를 사용하여 서비스를 제공하고, 유지하며, 개발하고, 개선하며, 관련 법률을 준수하고, 당사의 약관 및 정책을 시행하며, 서비스를 마케팅 및 광고하고, 서비스의 안전을 유지할 수 있습니다. 
귀하는 입력 자료로 사용되는 모든 자료에 대해 전적이고 독점적인 소유권을 보유하거나 필요한 모든 권리, 라이선스, 동의, 승인 및 허가를 보유하고 있음을 진술하고 보증합니다.

3. Output

Use of our AI Services may, in some situations, result in Output that (i) does not accurately reflect real people, places, or facts or is otherwise inaccurate, misleading, or false; (ii) may infringe a third party’s, intellectual property, publicity, privacy, or other proprietary rights; (iii) may be objectionable or contain bias; or (iv) violates the law. You should not rely on Output from our AI Services as a sole source of truth or factual information, or as a substitute for professional advice, or to be non-infringing, unobjectionable, or fully in compliance with the law. 
GoDaddy also does not review the Content for accuracy, bias or intellectual property, publicity, privacy, or other proprietary rights clearance. GoDaddy makes no representation, warranty or guarantee as to the accuracy or reliability of the AI Services or whether the Output may infringe on third-party’s intellectual property, publicity, privacy, or other proprietary rights. 
By using the AI Services or the Output, you understand and agree:
1. Output may not always be accurate. You should not rely on Output from our AI Services as a sole source of truth or factual information, or as a substitute for professional advice.
2. You must perform a human evaluation of the Output to ensure accuracy, truthfulness, and appropriateness for your use case before using or sharing Output from the AI Services. 
3. Our AI Services may provide incomplete, incorrect, offensive, or biased Output that does not represent GoDaddy’s views. You should always review, and when necessary revise, the Output to ensure accuracy and truthfulness and remove any offensive or biased materials. If Output references any third party products or services or expresses any views, it doesn’t mean that GoDaddy endorses the third party or is affiliated with GoDaddy or the views reflect GoDaddy’s views.
4. Outputs may not be unique across users and the AI Services may generate the same or similar Outputs for other user.
5. You must not remove or alter any AI related or other disclosures incorporated by GoDaddy into the Output.

4. Auto-Publish

The AI Services may offer features where Output is automatically posted directly onto your website, blog or your accounts on third party social media platforms (collectively, “Your Properties”) without any human intervention (“Auto-Publish”). If you consent to use Auto-Publish, you acknowledge and agree that:

GoDaddy has no control over the Output and does not review any Output prior to or after it is posted to Your Properties;
GoDaddy will provide you with a notice prior to Output being published to Your Properties to cancel or change the Output. If you do not cancel or change the Output pursuant to such notice, you are authorizing publication of the Output and the sole publisher of the Output. 
You will review all Output immediately after it is posted by the Auto-Publish to Your Properties and immediately remove any inappropriate content, including but not limited to content that is  defamatory, inaccurate, or infringes a third party’s rights or terms.; and 
There are inherent risks in the use of artificial intelligence and you are fully and exclusively responsible and liable for all Output that the AI Services post on Your Properties.

5. User-Facing Bots

AI Services may offer features that enable you to deploy automated communication tools (“Bots”) that will autonomously interact with users of your website (“your customers”) on your behalf and without human intervention. These Bots will provide responses to your customers using “your information,” which includes but is not limited to your website content, policies, information that you provide to GoDaddy, publicly available data, and feedback and instructions that you provide to the Bots. If you consent to the use of Bots, you will be deploying the Bots on your website and you acknowledge and agree that: 

You are solely responsible for the accuracy of your information.
You are solely responsible for reviewing all Bot responses to your customers and for providing accurate feedback and instruction to the Bot. GoDaddy does not review Bot responses or provide instruction or feedback to the Bots on how to interact with your customers. 
You remain fully responsible for all Output made by a Bot to your customers. 
Bots are not qualified to replace professional services and you will not make any representations or claims that could lead your customers to believe that a Bot can provide such professional services. 
While the Bots will draw from your information, feedback, and instructions as outlined within this section, Bot responses may contain erroneous or outdated information. Such erroneous responses could include promises, offers, claims, or other representations to your customers on your behalf that you may be required to stand behind. By agreeing to deploy the bots on your website, you fully and exclusively accept these risks and acknowledge that GoDaddy will not have any responsibility for erroneous Bot responses.

6. Third-Party AI Technology

GoDaddy may use technology provided by third-party service providers to provide AI Services (“Third-Party AI Technology”). Notwithstanding anything to the contrary contained herein, you authorize GoDaddy and such third-party service providers to store and use your Input for the purposes of providing you with the AI Services, to review Inputs and Outputs for abuse or misuse, and to develop and improve the services and products of GoDaddy and such service providers’ Third-Party AI Technology, including as part of the design, training and development process for machine learning models. GoDaddy assumes no responsibility for Third-Party AI Technology. By using the AI Services, you expressly release GoDaddy from any and all liability arising from your use of any Third-Party AI Technology. 

7. 종료 및 일시 중단

당사는 단독 재량에 따라 귀하의 AI 서비스 액세스를 일시 중단 또는 종료하거나 귀하의 계정을 삭제할 수 있는 권리를 보유합니다.

8. Compliance and Prohibited Uses

GoDaddy makes no representation, warranty or guarantee that Output or your use of AI Services will comply with any legal requirements that are relevant to you or your business. You are solely and exclusively responsible for all Output that you obtain through AI Services and for complying with all laws and regulations that apply to your use of AI Services, including but not limited to any disclosures or terms that need to be provided to your customers. 

You must not use AI Services to engage in conduct that is unlawful, harmful, abusive, inappropriate or is otherwise contrary to the terms of the Agreement. You must not Input or use AI Services to generate Prohibited Content.  

9. 고지 사항

귀하는 AI 서비스의 출력이 정확성, 편향성, 설명 가능성 또는 지식재산권 허가 여부를 검토받지 않았음을 명시적으로 인정하고 이에 동의합니다. GoDaddy은(는) 출력이 제3자의 지식재산권에 대한 침해, 오용 또는 위반 여부를 포함하되 이에 국한되지 않는 AI 서비스의 정확성, 신뢰성 또는 무오류 성능에 대해 어떠한 진술, 보증 또는 보장도 하지 않습니다.

귀하는 당사 AI 서비스의 출력을 사용하는 것은 전적으로 귀하의 책임이며, 출력을 정보 또는 사실 정보에 대한 단일 출처로 이용하지 않거나 전문가의 조언을 대신하는 것으로 의존하지 않을 것임을 인정하고 이에 동의합니다.

귀하는 AI 서비스가 생성한 출력을 사용하기 전에 독립적인 전문 자문을 구해야 합니다.

10. 책임의 제한

어떠한 경우에도 GoDaddy, 그 임원, 이사, 직원, 대리인 또는 제삼자 서비스 제공업체는 AI 서비스를 사용하여 생성된 출력을 포함하여 직접적, 간접, 부수적, 특별한, 징벌적 또는 결과적 손해에 대해 귀하 또는 다른 개인이나 법인에 대해 책임을 지지 않습니다.

또한 귀하는 어떠한 경우에도 GoDaddy의 AI 서비스 또는 AI 서비스를 사용하려 생성된 모든 출력과 관련하여 총 책임 금액 합계가 미화 1만 달러($10,000.00)를 초과하지 않는다는 것을 명시적으로 인정하고 이에 동의합니다.

전술한 책임의 제한은 법률에서 허용하는 최대한의 범위로 적용되며 본 계약이나 귀하의 본 사이트 또는 본 사이트에서 제공되는 AI 서비스 또는 기타 서비스의 사용이 해지되거나 만료되더라도 유효합니다.

법적 계약 및 정책의 번역된 버전은 영어 버전을 보다 쉽게 읽고 이해할 수 있도록 편의용으로만 제공됩니다. 법적 계약과 정책의 번역은 법적으로 구속력이 있는 계약을 작성하기 위해 제공되는 것이 아니며, 영어 버전의 법적 유효성을 대체하지 않습니다. 분쟁이나 충돌이 발생하는 경우 항상 법적 계약과 정책의 영어 버전이 당사자의 관계에 적용되며 기타 모든 언어에 포함된 약관보다 우선적으로 적용됩니다.
